Immigration Scams Targeting NYC Immigrants — And How to Protect Yourself

Every year in New York City, thousands of immigrants are victimized by fraudulent immigration "consultants," notarios, and fake attorneys who take their money, ruin their cases, and sometimes cause irreparable harm to their ability to remain in the United States.

This is not a small problem. It is a well-documented, widespread fraud that preys specifically on vulnerable communities — people who are desperate for help, may not fully understand the U.S. legal system, and sometimes fear going to authorities.

This guide explains the most common scams and how to protect yourself.

Scam 1: The "Notario" Fraud

In many Latin American countries, a "notario" is a highly trained legal professional — similar to an attorney. In the United States, a notary public is simply someone authorized to witness signatures on documents. They are not attorneys and are not authorized to provide legal advice or represent clients in immigration matters.

Unscrupulous individuals use the title "notario" to deceive Spanish-speaking immigrants into believing they are receiving legal representation when they are not. The results are often catastrophic — incorrectly filed applications, missed deadlines, or fraudulent applications that trigger permanent bars to immigration benefits.

Protect yourself: Only work with a licensed attorney (Juris Doctor, admitted to the bar) for any immigration matter.

Scam 2: The "Immigration Consultant" or "Document Preparer"

Some individuals advertise as "immigration consultants" or "document preparers." While document preparers can assist with form completion under your direct instruction, they cannot give legal advice, represent you at interviews or hearings, or tell you which forms to file.

When things go wrong — and with unlicensed preparers, they often do — these individuals are largely unaccountable. They may disappear entirely, leaving you with a damaged case and no recourse.

Scam 3: Guaranteed Results

No attorney can guarantee a specific outcome in an immigration case. Anyone who promises "guaranteed approval" or "100% success" is either lying or so inexperienced they do not understand the law.

Legitimate attorneys will give you an honest assessment of your case — including realistic odds and potential challenges.

Scam 4: Large Upfront Cash Payments with No Written Agreement

Legitimate attorneys provide written retainer agreements describing the scope of services and the fee structure. If someone asks for a large cash payment with no written contract, no receipt, and no clear explanation of what is covered — walk away.

Scam 5: The "Special Relationship" with USCIS or Immigration Judges

Some fraudulent operators claim to have "special connections" at USCIS, immigration court, or with government officials that will help your case. This is false. Immigration cases are decided on their legal and factual merits. There are no shortcuts, and claiming to have special access is a hallmark of fraud.

How to Verify a Licensed Attorney

  1. Ask for their New York State Bar number and verify it at iapps.courts.state.ny.us
  2. Check for an office address — not just a cell phone or P.O. Box
  3. Request a written retainer agreement before paying anything
  4. Report suspected fraud to the New York State Attorney General's office or the New York State Bar Association's grievance committee
