What to Do If ICE Comes to Your Door in the Bronx
Few moments are more frightening than a knock at the door followed by the words "Immigration and Customs Enforcement." But fear can cause people to make mistakes that hurt their legal case. Knowing your rights in advance can protect you and your family.
This guide explains exactly what to do — and what not to do — if ICE comes to your home in the Bronx.
Your Constitutional Rights Apply to Everyone
The Fourth and Fifth Amendments to the U.S. Constitution protect everyone in the United States — including undocumented immigrants. This is settled law.
You have the right to:
- Remain silent
- Refuse to open the door without a warrant
- Refuse to consent to a search
- Speak with an attorney before answering questions
You do NOT have to:
- Open the door for ICE agents
- Answer questions about your immigration status
- Sign any documents
- Go with agents unless they have a judicial warrant
Step 1: Do Not Open the Door
ICE agents cannot enter your home without a judicial warrant signed by a judge. They may carry administrative warrants issued by USCIS or ICE itself — these do not give them the legal right to enter your home without your consent.
If someone knocks, ask through the closed door: "Do you have a judicial warrant signed by a judge?"
If they do not, you may say: "I do not consent to entry."
If they produce a warrant, ask to see it slipped under the door. Examine it carefully:
- A judicial warrant will reference a federal court and bear a judge's signature
- An administrative warrant (Form I-200 or I-205) is issued by DHS — this does not authorize forced entry
Step 2: Stay Calm and Do Not Speak
If agents do enter (with a valid judicial warrant or if you feel you have no choice), remain calm. You have the right to remain silent. Exercise it.
Do NOT say:
- Where you were born
- How long you have been in the U.S.
- How you entered the U.S.
- Anything about your immigration history
You MAY say:
- "I am exercising my right to remain silent."
- "I want to speak with my attorney."
- "I do not consent to this search."
Step 3: Do Not Sign Anything
ICE agents may present documents for you to sign. Do not sign anything without consulting an attorney. Signing certain documents — such as a voluntary departure form — can waive important legal rights.
Step 4: Contact an Immigration Attorney Immediately
As soon as possible, call an immigration attorney. If a family member has been detained by ICE, time is critical — they may be transferred to a detention facility quickly, and a bond hearing needs to be requested.
